झारखंड उच्च न्यायालय में न्यायाधीश आनंद सेन की अदालत में रिट संख्या 1868/2026 की सुनवाई हुई
पिटीशनर सूर्य पद महतो ने रिट में अदालत से गुहार लगाई थी कि कुछ लोग सरहुल पर्व के नाम पर सहरबेड़ा स्थित प्लाट नंबर 395, 397, 403 और 404 की उनकी लगभग 7.5 एकड़ जमीन 2024 से कब्जा करने की कोशिश कर रहे हैं! उन्होंने माननीय अदालत को यह बताया कि एसडीएम, उपायुक्त, एसपी और आयुक्त को आवेदन देने के बाद भी कोई कार्रवाई नहीं की गई है

उन्होंने आगे यह भी बताया कि एसडीएम ने एक पत्र द्वारा उन्हें अपने दफ्तर में बुलाया है जबकि उक्त पत्र में यह नहीं बताया गया है कि किस अधिकार और किस वजह से उन्हें बुलाया गया है!
वादी की फरियाद सुनने के बाद न्यायाधीश ने वादी को यह निर्देश दिया के वे अपनी जमीन के कागजात के साथ आज 3 बजे एसडीएम से मिले न्यायाधीश ने यह भी निर्देश दिया कि अगर एसडीएम को कागजातों का अवलोकन करने के बाद यह लगता है कि जमीन पर प्रथम दृष्टया वादी का अधिकार है तब वे वादी के जमीन पर उसके अधिकार की रक्षा करेंगे
उच्च न्यायालय की रजिस्ट्री ने भी लगभग 1.30 बजे तक उक्त आदेश की प्रति को एडीएम और अन्य पदाधिकारियों के दफ्तर में फैक्स के माध्यम से भेज कर उन्हें सूचित भी कर दिया

02 /20.03.2026: Heard the learned counsel representing the respondents
and the learned counsel representing the petitioners, Mr. Akhilesh
Kumar Shrivastava through virtual mode, who does not complain
about the clarity and quality of video and audio.
2. It is the grievance of the petitioners that a particular festival
is being tried to be forcefully organized over the land which belongs
to these petitioners. The petitioners are aggrieved by Annexure-7
by which a notice under section 144 Cr.PC has been issued by the
Sub-Divisional Officer to the petitioners. The petitioners prays for a
direction to safeguard their property i.e. land.
3. Considering the nature of the dispute and the claim made
by the petitioners, I direct the petitioners to appear before the SubDivisional Officer, Chandil, District Saraikela Kharsawan by today
itself at 3:00 P.M. along with all the documents which the
petitioners claim as proof of his title.
4. If the documents substantiate prima facie title in favour of
the petitioners, it is the duty of the Sub-Divisional Officer, Chandil to
protect the property of the petitioners.
5. Accordingly, this writ petition is disposed of.
6. Let a copy of the order be immediately handed over to the
learned counsels for the State and the petitioners.
